1. Acceptance of Terms

By accessing www.potterpublishers.com or engaging Potter Publishers ("we", "us", "our") for any service, you ("Client", "you") agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree, please do not use our website or services.

2. Services

We offer book publishing, custom book cover design, professional ghostwriting, children's book publishing and illustration, and book marketing services. The specific scope, deliverables, timelines, and fees for each engagement will be set out in a written quote or statement of work signed by both parties ("Service Agreement"). In the event of a conflict, the Service Agreement controls over these Terms.

3. Author Intellectual Property

You retain 100% ownership of the underlying manuscript, book, and final published work (collectively, "Author IP"), subject to the following:

  • You warrant that you own or have the right to use all content you provide and that it does not infringe any third-party rights;
  • You grant Potter Publishers a limited, non-exclusive license to reproduce, format, design, and distribute the Author IP solely as needed to deliver the services;
  • For ghostwriting engagements, Potter Publishers assigns all rights in the ghostwritten work to you upon full payment, subject to the confidentiality terms below;
  • Potter Publishers retains ownership of its own templates, brand assets, internal methodologies, and process documentation.

4. Pricing and Payment

Prices are quoted in U.S. dollars unless stated otherwise. Unless your Service Agreement says differently:

  • A non-refundable deposit is due to start work;
  • Remaining balances are billed at agreed milestones or before final delivery;
  • Invoices are due upon receipt;
  • Overdue balances may incur late fees and may pause work in progress.

5. Refund Policy

We offer a 7-day money-back guarantee from the date of initial payment, subject to the following conditions:

  • The refund request must be submitted in writing to info@potterpublishers.com within 7 calendar days;
  • The guarantee does not apply once substantive work (more than minor preliminary discussion) has been delivered;
  • Third-party costs already paid on your behalf (ISBN registration, stock images, printing setup, distribution fees, etc.) are non-refundable;
  • After the 7-day window, refunds are at our sole discretion and limited to undelivered portions of the engagement.

6. Confidentiality

We treat all manuscripts, drafts, project plans, and related information you share as confidential. For ghostwriting engagements specifically, our writers and project managers are bound by non-disclosure agreements; the writer's identity and contribution remain confidential, and authorship credit on the cover belongs to you.

7. Client Responsibilities

To deliver high-quality work on time, we need your active participation. You agree to:

  • Provide source materials, references, and reviews within agreed timeframes;
  • Respond to revision requests and approvals promptly;
  • Ensure the content you submit is lawful and does not contain defamatory, infringing, or otherwise unlawful material;
  • Pay invoices on time.

Delays caused by missing input or feedback may extend timelines and are not grounds for refund.

8. Revisions

The number of revision rounds included in each service is specified in your Service Agreement. Revisions outside that scope, or changes to previously approved deliverables, may be billed at our then-current hourly rate.

9. Disclaimers

Our services are provided on an "as is" and "as available" basis. While we work diligently to deliver high-quality results, we do not guarantee specific commercial outcomes, including book sales, reviews, rankings, retailer acceptance, or media coverage. Publishing is inherently competitive, and outcomes depend on factors beyond our control.

10. Limitation of Liability

To the fullest extent permitted by law, Potter Publishers' total liability for any claim arising out of or related to our services is limited to the fees you paid for the specific service giving rise to the claim. We are not liable for indirect, incidental, consequential, special, or punitive damages (including lost profits, lost royalties, or reputational harm), even if advised of the possibility.

11. Indemnification

You agree to indemnify and hold harmless Potter Publishers from any third-party claim arising out of content you provide, including claims of copyright infringement, defamation, invasion of privacy, or violation of any law, except to the extent caused by our negligence or willful misconduct.

12. Termination

Either party may terminate an engagement with written notice for material breach uncured after 10 business days. Upon termination, you will pay for all work completed up to the termination date; we will deliver work in progress in its current state.

13. Third-Party Platforms

When we publish your book through third-party platforms (Amazon KDP, IngramSpark, Barnes & Noble Press, Audible, etc.), those platforms' terms also apply. You are responsible for reviewing and complying with their policies. Potter Publishers is not responsible for delays, takedowns, or account actions imposed by those platforms.

14. Governing Law and Venue

These Terms are governed by the laws of the Commonwealth of Kentucky, USA, without regard to its conflict-of-laws principles. Any dispute will be brought exclusively in the state or federal courts located in Fayette County, Kentucky, and both parties consent to that jurisdiction.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with a revised "Last updated" date and, where appropriate, communicated by email. Continued use of our services after a change constitutes acceptance of the updated Terms.

16. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force.
